Jobi operates an online job board platform that connects job seekers ("Candidates") with employers ("Employers") (collectively, "Users"). Our Services include:

  • Communication tools between Candidates and Employers

  • Premium subscription services

Jobi acts solely as an intermediary and does not guarantee employment outcomes or the accuracy of information provided by Users.

3. ELIGIBILITY AND REGISTRATION

3.1 Age Requirement

You must be at least 16 years old to use our Services. By using Jobi, you represent and warrant that you meet this age requirement.

3.2 Account Registration

To access certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

3.3 Account Types

Candidate Accounts: For individuals seeking employment opportunities

Employer Accounts: For companies and organizations posting jobs and recruiting candidates

You may not create multiple accounts or transfer your account to another person without our permission.

4. USER CONDUCT AND RESPONSIBILITIES

4.1 General Rules

You agree not to:

  • Violate any applicable laws or regulations
  • Post false, misleading, or fraudulent content
  • Impersonate any person or entity
  • Harass, abuse, or harm other users
  • Use automated systems (bots, scrapers) without permission
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt our Services
  • Upload viruses or malicious code
  • Engage in discriminatory practices
  • Solicit users for purposes unrelated to employment

4.2 Candidate Responsibilities

As a Candidate, you agree to:

  • Provide truthful information in your profile and applications
  • Only apply for positions you're genuinely interested in
  • Respect confidential information shared by Employers
  • Communicate professionally with Employers

4.3 Employer Responsibilities

As an Employer, you agree to:

  • Post only legitimate job opportunities
  • Comply with all employment laws and regulations
  • Provide accurate job descriptions and requirements
  • Not discriminate based on protected characteristics
  • Respect Candidate privacy and confidentiality
  • Use Candidate information solely for recruitment purposes

5. CONTENT AND INTELLECTUAL PROPERTY

5.1 User Content

You retain ownership of content you submit ("User Content"). By posting User Content, you grant Jobi a worldwide, non-exclusive, royalty-free license to use, copy, modify, display, and distribute your content for operating and improving our Services.

5.2 Jobi Content

All content provided by Jobi, including text, graphics, logos, and software, is owned by Jobi or its licensors and protected by intellectual property laws. You may not use our content without written permission.

5.3 Feedback

Any feedback, suggestions, or ideas you provide become the property of Jobi without compensation to you.

6. PRIVACY

Your use of our Services is subject to our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

7. FEES AND PAYMENT

7.1 Free Services

Basic Services are provided free of charge to Candidates. Basic job posting may be free for Employers, subject to limitations.

7.2 Premium Services

We offer premium features for additional fees, including:

  • Enhanced job postings
  • Advanced search filters
  • Priority support
  • Analytics and insights
  • Bulk job posting capabilities

7.3 Payment Terms

By purchasing premium services, you agree to:

  • Pay all fees according to the selected plan
  • Provide accurate payment information
  • Authorize automatic renewals (if applicable)

7.4 Refunds

Refunds are provided according to our refund policy. Generally, monthly subscriptions are non-refundable, while annual subscriptions may be eligible for pro-rated refunds within 30 days.

8. DISCLAIMERS

8.1 No Employment Guarantee

Jobi does not guarantee job placement, interviews, or any specific employment outcome. We are a platform that facilitates connections between Candidates and Employers.

8.2 User Screening

We do not screen or verify Users beyond basic registration requirements. You are responsible for conducting your own due diligence.

8.3 Third-Party Content

We are not responsible for third-party content, including job postings, resumes, or external links. Users interact at their own risk.

8.4 Service Availability

Services are provided "as is" and "as available." We do not guarantee uninterrupted or error-free operation.

9. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOBI AND ITS AFFILIATES SHALL NOT BE LIABLE FOR:

  • ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
  • LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES
  • DAMAGES ARISING FROM USER INTERACTIONS OR EMPLOYMENT DECISIONS
  • DAMAGES EXCEEDING THE FEES PAID BY YOU IN THE PAST 12 MONTHS

10. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Jobi, its affiliates, and their respective officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your User Content
  • Any employment-related claims between Users

11. TERMINATION

11.1 Termination by You

You may terminate your account at any time through your account settings or by contacting support.

11.2 Termination by Jobi

We may suspend or terminate your account if you:

  • Violate these Terms
  • Engage in fraudulent or illegal activities
  • Harm other Users or our reputation
  • Remain inactive for an extended period

11.3 Effect of Termination

Upon termination:

  • Your access to the Services will cease
  • We may delete your account and content
  • Provisions that should survive will remain in effect

12. DISPUTE RESOLUTION

12.1 Informal Resolution

Before filing a claim, you agree to try to resolve disputes informally by contacting us at legal@jobi.com.

12.2 Arbitration Agreement

Any disputes not resolved informally shall be resolved through binding arbitration in accordance with the American Arbitration Association rules. This agreement to arbitrate includes claims against Jobi's affiliates, employees, and agents.

12.3 Class Action Waiver

You waive any right to bring claims as a plaintiff or class member in any purported class or representative proceeding.

12.4 Exceptions

This arbitration agreement does not apply to claims for injunctive relief or intellectual property disputes.

13. GOVERNING LAW

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any legal action not subject to arbitration must be filed in the courts of San Francisco County, California.

14. GENERAL PROVISIONS

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Jobi.

14.2 Severability

If any provision is found unenforceable, the remaining provisions will continue in effect.

14.3 Waiver

Our failure to enforce any right or provision does not constitute a waiver.

14.4 Assignment

You may not assign these Terms without our consent. We may assign our rights and obligations without restriction.

14.5 Notices

We may provide notices through your account, email, or by posting on the Site.
